Winning Strategies

In over 20 years of practicing Social Security Disability Law, I have developed case strategies for literally thousands of disability cases.  In this section of my website, you will find both general case strategies as well as case strategies specific to specific illnesses.

In a nutshell, there are 3 main strategies I use to win a disability case:

  1. The Residual Functional Capacity Strategy
  2. Meeting a Listing
  3. The Grid Rules Strategy

Additionally, I find it useful in some cases to take a closed period strategy - meaning that since you are better now and able to return to work, I argue that you were disabled for a certain period of time (the “closed period”).

Finally, a strategy I have employed recently is writing pre-hearing briefs or on-the-record requests for the judges to review prior to the hearing. This often results in either A) a favorable decision issued before the hearing or B) a quick, painless hearing.
