Case Strategy for Disability Claims
Based on Colitis/Crohn’s Disease

In order to win a Social Security Disability case, you need to prove to the Social Security Administration that you cannot perform even an unskilled, entry level job. The medical information in your file needs to show that you would not be able to work reliably. If you are trying to prove a Crohn’s disease disability case, then your argument would most likely involve the pain and weakness caused by this disease.

There are two basic arguments that my firm uses when dealing with a Crohn’s and Colitis case. Depending on what the evidence is and the nature of the case, I might use one of the methods or both of them. The strategy we choose will also depend on the quality of the witnesses.

The first type of argument requires qualifying for the Social Security Administration’s listing requirements for inflammatory bowel disease. Obviously, this type of argument relies primarily on the records in your medical file. The 2nd type of argument evaluates your ability (or inability) to work, and examines all of the medical evidence for support. It takes into account side effects of medicine, other medical and mental health issues added to your existing Crohn’s disease, and your doctor’s testimony concerning what type of work you are (or aren’t) capable of.

Both arguments rely on the fact that you have had and currently undergoing treatment by doctors for your condition. They also are based on the assumption that you would often have to take unscheduled breaks or miss at least several days of work each month.
